Basically 4 rules:
(Each item is link to more details)
   1) These are copyrighted graphics.
2) Use requires link back to my site.
3) No cost for some uses, low cost for others.
4) NO direct linking / hot linking, it is bandwidth theft.
Detailed explanations below are linked from these four rules. They are detailed because many people do not know what copyright is, do not know what 'requires link' means, or do not know that direct linking is bad. All they know is what someone showed them how to do.

1)  These are copyrighted graphics.
Free for you to use, does not mean that no one owns the graphics, and they are public domain. The copyrighted graphics shown on these pages may NOT be placed in any collection, be redistributed in any manner (including email lists), or sold. They cannot be used to create other things that are sold, without written permission, or purchasing the graphics.

When you use something that YOU DID NOT CREATE, and you use it in ways that are against the wishes of the one who DID create it, that is copyright violation. When YOU create something from scratch, you can set your own terms for how you allow your creation to be used.

Create means: write, draw, photograph, create in a computer graphic program, etc. Not just edit someone else's creation, and not re-draw something that has already been created, like Disney, Loony Toons, Precious Moments or other copyrighted characters, etc. If you don't have written or posted permission to use the graphics, you are violating copyright laws by using them. Even when you do have permission, that doesn't mean you can re-distribute them (offer/give to other people in any way).

2)  Use requires a link back to my site, please,
using the button that matches the set you are using, OR one of the 'generic' buttons available, OR a text link. Can be teeny-tiny text, the smallest you can make it, that's okay! at the bottom of the page the graphics are on. *How-to* make a link information is on this graphic, take it with you if it helps to remember how to write HTML code for a link.

3)  Free (4 a link) for your OWN use on non-selling: personal, 501(c)(3) non-profit, church + ministry, and education / school / college sites. For web pages, email stationery, wallpaper, and printed personal (i.e. non advertising) use only.

If you sell *ANYTHING AT ALL*, even raffle tickets, or have a site that encourges people to contact you regarding your business, then you have a commercial page / website. For my graphics, a commercial page / website would need to purchase the license to use my graphics. The prices are very reasonable. Some graphics can NOT be used for commercial purposes at all, per the license agreement of the place where I got the graphics. You would have to ask about specific graphics that you are interested in using.

If you pay someone to create your website, or if it is created (paid or unpaid) by a web design/development company and has their 'created by' information on the site, then you will need to purchase the license to use the graphics.

It *IS* okay to belong to banner exchange services, but if you have banners that you get paid for by click through, or by impression, then you're a commercial site.
It *IS* okay to have a promotional/affiliate link to Amazon, CD Now, and all the referral services that Yahoo!/Geocities and the other free website providers allow it's members to use.
Unfortunately, if you think you will *really* make tons of money from links to those types of places, then you don't really know how their program works. Read about it here, scroll down to "word to the wise" and start reading!

Helpful Hint: When you get to that page, hold your 'Ctrl' button on keyboard and hit the letter 'F' key. That will bring up a search string box. Type in 'word to the wise', hit the 'Find Next' button and it will FIND that phrase on that page!

If you contact me about paying for graphic use on a commercial website, mention you are interested in the "TOU discount" or mention you visited the terms-of-use page. I will know you visited this "terms-of-use page" in the free graphic area, and I will give you a special, discounted price -- this notation of a discount is not on ANY other page in my sites, available ONLY to vistitors of this page. On rare occasion, I give written permission for a commercial site to use my graphics without payment. Circumstances vary, so you would have to ask.

You CAN go buy your OWN graphics, ones you can do (most) anything YOU want to with, from Publisher's Toolbox, Dynamic Graphics, Artville, Stockbyte, EyeWire, PhotoDisc or others. Be sure to read the terms-of-use on whatEVER graphic packages you buy. What they allow you to do with the graphics will vary!
 
 
4)  I pay for the amount of bandwidth that my site uses, and will NOT pay for bandwidth to display graphics on other people's sites / emails / bulletin boards.

Directly linking to graphics on my server is like a slap in the face! I spend my time (and money for the graphic programs) to create graphics that are free for others to use for non-commercial purposes. I don't have *any* kind words for those who directly linked to my graphics to display on their web pages, bulletin boards, and in their email. I can (and will) track you down and have your site deleted or your ISP service discontinued

Please do NOT link directly to the images on this site (also called 'hot linking'). Doing so is bandwidth theft!


DO:

Download/save the graphics to your computer and upload to your server, as you did for your HTML pages. Right click (PC) or Click + Hold (Mac) over the image you want, and choose "save graphic as ..." to a file folder on your computer.

DON'T:

this means you must NOT put the code
IMG SRC="http://www.autumnweb.com/Roxys/imagename.gif"

or anything similar in your HTML coding to display images that are located on MY server on YOUR web page, or in your emails, or on your bulletin boards. By doing so, you are a bandwidth thief and deserve any consequences you receive.


If you think I am being unreasonable in this request,

I hope your neighbor hooks up their hose to YOUR faucet to fill their in-ground swimming pool;

or hooks an extension cord to YOUR socket to power their lights;

And YOU get stuck with the bill for all that water or electricity. THAT is what direct linking, hot linking, (which is bandwidth theft) is equivalent to!

You have NO idea how many great sites have disappeared the past few years because they couldn't afford the bandwidth cost when people would not respect their request to NOT direct link to graphics, music files, etc. I really don't want to, but may have to consider removing all the free graphics, as other former free graphic creators have done.

How-To Save Dowload / save the graphics to your computer:
Right click (PC) or Click + Hold (Mac) over the image you want, and choose "save graphic as ..." ("save image as ...", "save background as ...", etc.) to a file folder on your computer. Then upload the graphics to your OWN web server, as you did for your HTML pages, to use on your web pages, in your emails, etc. WebTV users (and anyone else), can get free server space at many places.

The potential Consequences for not complying with these terms-of-use requests below. Not obeying the 'terms-of-use' means you will be in violation of copyright. A complaint to your web host, ISP, etc. will have your site / service discontinued. They ALL have 'terms of service' (whether you read them or not), and copyright violation and theft (bandwidth or otherwise) is listed there. Roxy's Renditions graphics terms-of-use is clearly stated. A link to this page is on EVERY graphic page on my websites, so saying 'but I didn't know' will not be believed by your web host, ISP, etc.

Bandwidth Theft Consequences:

I do (as most people who have their own domain do) have a notification system to tell me if anyone is directly linking to my graphics. My domain name web host provides referrer logs [more info]. At minimum, direct linking to my graphics will get you broken grey boxes or red X boxes on your page or in your emails, etc.

When I find graphics being pulled by a different server :
(meaning: displayed on another HTML page or in email, or on a bulletin board, etc.)

  • I could (and probably will) replace the graphic being pulled/used with a very nasty graphic that will show up on your pages or in your email. One that will tell all your friends, visitors, people who receive your emails or view your BB posts that YOU are a scumbag thief for stealing bandwidth. I can do ANYthing to the images on MY server that I want to. Since the graphic is under my control, I can replace and rename graphics at any time. Do you really want your page or emails to look like this, or worse?!? I don't think so. This is what you are asking for when you direct link to images on my server (or ANYONE's server) instead of saving them to your computer and uploading to your OWN webspace. Or WebTV users not using the transloader to move the images from my web server space to your own.
     
  • I could (and probably will) complain to your web host, WebTV server, or email server about bandwidth theft, which may get your pages/site/service/bulletin board deleted by the server.
     
Bandwidth theft is against the law. ALL webpage hosts , email servers and WebTV servers, free or paid-for ones, have 'terms of service' and theft is covered there.

No web page server, email server, or WebTV server is going to want to have criminal charges, or a civil suit for $$ compensation by me (or someone else), to repay the bandwidth that was stolen, plus court cost, plus lawyer costs, plus the added amount for "time, pain and suffering" it has caused me because I have to rename image names and directories. No, they will delete your account or discontinue your service first!
